Answer: Introduction: There are a number of rules that apply in case of ordinary contracts that have been concluded between parties orally or in writing. These rules also apply in case of electronic contracts. Electronic contracts are created online, using e-mail or other electronic means. These days, an increasing number of businesses and suppliers are opting for online credit applications with the customers were not present face-to-face and in some cases, they're not even present in Australia. Under these circumstances, the effects of the rules applicable in case of electronic contracts become much more significant. Several of these rules have been considered by the courts, for example the Supreme Court of Queensland in Stellard's case where they have to deal with the issue of signing a contract by e-mail in case of a contract according to which an interest in land has been created. Issues related with electronic Contracts: While considering the issues related the electronic contracts, there are mainly three parts of the issue related with the impact created by electronic contracts. Never was a college has to be seen if an e-mail can be treated as a signature, when the terms and conditions, guarantees and the credit applications need to be signed by the parties. This requirement is especially relevant in cases where the creditors had relied on charging clause for the purpose of lodging caveats related with interest on land or guarantees. In this regard an example can be given of the Stellard's case where Stellard wanted to purchase land from NQF and for this purpose, several e-mails were exchanged between the parties. Ultimately, an e-mail was sent by Stellard to NQF in which the amount that the company was going to pay has been mentioned and similarly in this e-mail, the general terms of the offer were also mentioned. The refore in other words it was the offer e-mail. In this case, a formal contractual document was not present between the parties, that was in writing or electronically encrypted signatures have been placed on it. Under these circumstances, the son of the director, Drew was considered as an agent of NQF, had sent an e-mail, accepting this offer. At the end of this e-mail, the name Drew was intentionally mentioned. In this regard, NQF had agreed that e-mail containing the acceptance of the offer was sent by Drew but the company claimed that the e-mail was only a memorandum or a note in writing and therefore it was not an acceptance e-mail. Similarly, arguing on these grounds, the NQF also alleged that the acceptance e-mail had not resulted in the formation of a valid contract related with land, due to the reason that it was not signed. Under these circumstances, the issue in this case was if the acceptance e-mail can be treated as a signed memorandum or writing. In order to deal with these issues, a national scheme of legislation has been applicable in Australia that deals with electronic transactions. In this regard, the Electronic Transactions Act, (Vic) 2000 needs to be mentioned. Similar the legislations have also been limited in other countries. As a result, in Stellard's case, the court was of the opinion that considering the trail of e-mails that were exchanged between the parties, the acceptance e-mail sent by the agent of NQF had signatures and therefore, an enforceable contract that was related with land, has been formed between the parties because it was a writing or a memorandum signed by the registered owner of the land or its agent. Under these circumstances, it was the decision of the court that when the parties were conducting negotiations with the help of e-mail and especially when one party has made an offer using e-mail, it can be inferred by the court that the consent regarding the use of e-mail for this purpose has been granted due to the conduct of the parties. Hence, it was mentioned by the court that while communicating their negotiations by using e-mail, th ere was an implied consent given by NQF relate with the method of signing by using an e-mail. The display of goods on the internet does not amount to an offer but it is merely an invitation to treat as is the case under contract law. It is also worth mentioning at this point that the law of electronic transactions will apply to the terms and conditions mentioned by the supplier, will depend on the words that have been used in them and also regarding the e-mails and other electronic communications that have been used by the businesses for credit applications and guarantees, especially, if a trail of e-mail is not present between the parties. Consequently, if it is done aptly, a document can be signed by using electronic means other than e-mails, although it is required in such a case that the supplier has strictly followed the provisions of the applicable electronic transaction laws. Essential Elements: As mentioned above, the elements that are necessary in case of ordinary contracts, are also required in case of electronic contracts. In this way, it is essential that the elements like offer, acceptance and consideration along with the intention of the parties to create a legal relationship as well as the capacity of the parties should be present in case of electronic contracts. But in such a case, which may arise that when the terms and conditions and guarantees need to be assigned for the purpose of being enforceable. Hence, generally the terms and conditions and guarantees provide the express terms for securing any payment that may be owed to the supplier. In this regard, an example can be given of the case where it has been provided that the supplier shall retain the ownership in the goods until they have been paid off. In the same way, sometimes a charge is granted to the supplier in case of any interest in land that the customer has, either present or future. Such a situation is known as a charging clause. In case of a charging clause, the supplier is allowed to lodge a caveat related with an interest in land, registered in customer's name. It has been established as a significant related with the purpose of debt recovery. For lodging a caveat in accordance with the Australian law, the terms and conditions (as in Stellard's case) need to be signed by the customer. A similar requirement is also present in most of the other countries regarding the caveat lodging system. Similarly, in the context of the guarantees, generally a charge is granted in context of an interest in real property of the guarantor. It is called a general charging clause. The Australian law provides in this regard that guarantee needs to be signed by the guarantor or its agent for the purpose of being made enforceable. The test that can be used for deciding if an e-mail has been signed by the guarantor or its agent is the test provided in Stellard's case. Similarly, the requirement tha t provides that the guarantee needs to be signed is also applicable in most of the other countries. Electronic Signatures: Therefore the situation regarding electronic contracts can be described that under the law, electronic signatures are valid for creating a legally enforceable agreement. But in some cases, a difficulty may arise regarding electronic signatures when evidence has to be provided for confirming the identity of the person who has signed the contract or regarding the intention of the parties that they will be bound by the agreement. Although, it is possible to mitigate these risks by using the digital signature tools that include the context of identity verification and also the methods used for authenticating like public-key cryptography however still there are some important issues that have to be considered. The result is that although the law recognizes electronic signatures but still there can be some difficulty in proving the signatures. As noted above, for the purpose of creating a valid contract, certain elements are considered as being essential. The intention of the parties to cr eate a legal relationship is also one of these elements along with the acceptance of the offer and providing consideration. Therefore, in context of commercial transactions, the use of electronic means for creating and executing a valid contract requires the presence of these elements under the Australian law and also in accordance with international law. Therefore, as is the case with paper contracts, these elements are required in electronic contracts also. But other than the requirements that have to be fulfilled in case of paper contracts, in case of electronic contracts, the contract is considered as a valid only if it has been stored appropriately and is capable of being accessed after it has been executed. Similarly, another requirement is that the parties should expressly or impliedly give their consent that in case of a particular agreement, information will be supplied by using electronic means. It also needs to be pointed out that the law provides that in such case the pu rported originator of the communication is treated to be bound by it if the communication was sent by the originator or with the consent of the purported originator. But this causes a problem related with establishing the fact that this element is present, particularly when the parties were not dealing face-to-face and consequently, they are not in a position to verify the identity with the help of traditional means. Increasing use of Electronic Contracts: These days, the number of e-mails sent by businesses had surpassed the traditional letters and faxes. In this way, e-mails are being preferred by the businesses for various purposes including contract negotiations. Generally it is believed that courts are behind the times but in this context, the shift in communication has been recognized by the courts and as a result, the courts have accepted e-mail as one of the means to create a legally enforceable contract. But still there are a large number of businesses that are not aware of this fact. These businesses mistakenly believe that anything agreed over the e-mail is not considered as binding and similarly, they also under the impression that an enforceable contract can be created only if there is a written document present that is signed by them. However, according to the law, if the parties have been negotiating an agreement by using e-mail, but they do not desire that these e-mails should result in a binding agreement, they should clearly mention this fact in the e-mail that a binding contract will not be created unless they have executed a formal contract. But if such a condition was not expressly mentioned by the parties, it is not likely that it will be implied by the courts in these e-mails. In this regard, the example of Stellard's case can be given in which it was held that a binding contract for the sale of land has been executed by e-mail. It is also worth mentioning at this point that in case of the offer e-mail and the acceptance e-mail, it was mentioned by the parties that it is subject to contract and subject to execution. After the parties have exchanged these e-mails, the buyer had sent a contract for being executed but it was not signed. Therefore, the seller withdrew from the transaction and entered into a contract with a third-party. Under these circumstances, it was held that regarding e-mails, it is the intention of the parties that they will be bound by the agreement immediately. This situ ation prevails even if the parties had expected that such an agreement will be replaced by a formal contract that will carry additional terms also. The court also held that the requirement has been fulfilled by the e-mails which provide that a contract regarding sale of land needs to be in writing and signed, keeping in view the Electronic Transactions Act, 2001. A similar decision was earlier given in Vantage Systems Pty Ltd v Priolo Corporation Pty Ltd when it was held that a the eighth foreseeable agreement is present between the parties related with the lease of commercial premises through e-mails although the parties have mentioned that it was subject to approval. The court also ignored the fact that in this case the parties could not agree regarding the reinstatement clause. Similarly the court was not infected by the fact that Nader on the parties have not signed a formal lease although they intended to do so. Similarly the trend, according to which the e-mails are considered as binding, have also been extended to the settlement negotiations among lawyers using e-mails. Therefore in Universal Music Australia Pty Limited v Pavlovic, it was held by the NSW Supreme Court that the parties have created a binding settlement through the e-mails that were exchanged by their lawyers. The court further mentioned that the e-mail of the lawyer men tioning that the client will sign the settlement deal as well as, keeping in view the other communications and the parties conduct, it was held that a binding agreement has been concluded. Conclusion: In view of the rapid expansion of World Wide Web and e-commerce, the number of contracts that are created by using electronic means, has increased significantly. Americans just don’t seem to have some happiness in their lives anymore, and we should wonder why that is the case. The educational system doesn’t seem to be any better when it comes to helping us out with our own happiness there are just too many restrictions going on. The students can’t be themselves. Employment has become a need rather then people wanting to wake up every morning and looking forward to going to work. There is just so much going on, like economic problems, job cuts and people can’t find happiness anywhere. A person’s wellbeing should always be first especially when it comes to there happiness. It seems that the American government has put aside what their first responsibility to Americans is, which is making sure that the people are happy. In â€Å"Get Happy† Mosley says, â€Å"But our potential for happiness has lagged far behind,† and what I’m getting from this is that our citizen‘s wellbeing isn‘t put first, rather it is being put to the side and not being an important element of people‘s lives. The government isn’t doing their job in making sure we’re happy. They seem to be doing the bare minimum and just worrying about what is necessary to â€Å"help† the people in every way they can, but they don’t show any interest in their happiness. Education is now a big issue as well, for the fact that now schools are being referred to as being â€Å"prisonlike.† What I’m getting from all this is that there are just too many restrictions on students, and there is no sense of freedom at schools. Schools are being built in a prison like manner and just like in prison there is always someone of higher authority watching over everyone which might make people feel like they can’t be themselves and express how they might feel about certain things. Americans just aren’t happy with anything that’s going on around them because they’re being treated as is they were insignificant. We have the right to be happy, but its like no one is pursuing that goal anymore. They are settling for what they have. In other words, they’re just learning to live their lives the way they are. Jobs now have become so meaningless, and the only reason people stick around at their jobs is because they have to in order to be able to provide for their families. We are now just being controlled as if we were puppets. The government’s priorities have changed so much and happiness for Americans isn’t important to them anymore. In the reading it says, â€Å"Citizens are not treated like members of society but more like employees who can be cut loose for any reason large or small,† this just goes to show that people don’t seem to be important, especially them being happy. Citizens just feel the need to work because that’s one of the only way they can make it in life, and be able to provide for their family, even if it means waking up every morning and not looking forward to going to work. Citizens are unhappy because they have to take labor intensive jobs that enslave them. People even think that the more money they have that they have the happier they will be, but the reality is that money does not buy happiness. It might buy you what you want like a huge television, but doesn’t mean you’ll be happier. If a person has a good empowering education they might be more confident and want to accomplish many goals. This will bring them more happiness because they know they were able to take control of their own lives and get to where they want to be. For example, when someone has a job they hate and don’t look forward to going to work its because they might not of had the same opportunities as someone else. No one should have to settle for what they have, if a person keeps trying they can reach their happiness. If the school system is bad then of course the students won’t feel encouraged but rather feel forced to be there since most of the times there is no other choice. Of course having a dull job and bad school system will lead to a person’s unhappiness. When a person sets their own goals and doesn’t give up no matter the obstacles, and later make their goals come true a person will be a lot happier. Just knowing they accomplished what they set their mind will show them that they don’t have to settle for a meaningless job and especially being an unhappy person. Salvador Dali Salvador Dali, one of the most famous artists of the 20th century, was very active even in the latter part of his life. He not only painted, but also showed to be creative in the artistic world in general. He traveled, and along the way learned different techniques of painting, but always went back to paint as he described it ‘hand painted dream photographs’. (Sandoval, 1998) Dali emerged as a leader of the Surrealist movement, where he was the most faithful and only true surrealist, although he was later expelled from because of his political views and more traditional work. During this time he created a painting, Persistence of Memory (1931), which is still on of the best-known surrealist works. (Sandoval, 1998) Dali’s work was different to others since all of his discoveries and inventions are reflected in his work and appear in them in a scarcely transposed form. He and Gala later moved to the United States, during World War II, were he devoted himself to self-publicity and began to paint pictures of religious themes. One of these paintings includes, The Crucifixion of St John of the Cross, (1951). During this time, he also showed the world that he was not only a great painter, but had other talents as well. For example, he designed jewelry, apartments, clothing, costumes, shop interiors, and stage sets. Along with this he also worked for Vogue and Haper’s Bazaar. (Neret, 1997) This also led him to take part in the production of films such as, ‘An Andalusian Dog’ and ‘The Golden Age’, where he worked in collaboration with Bunuel. (Folkes, 1999) Gigantism was predominant in Dali’s late work. The paintings that he created during this part of his life were a combination of all of the styles, which he had worked on. They include: Surrealism, â€Å"quintessential pompierism†, pointillism, action painting, Tachisme, geometric abstraction, Pop art, Op art, and psychedelic art. (Neret, 1997) Some of these pictures include, The Discovery of America by Christopher Columbus (1958-59), and Tuna Fishing (1966-67). Stereoscopy was also used by Dali in some of his paintings such as, Dali from the Back, Painting Gala from the Back, Etermalized by Six Virtual Corneas Provisionally Reflected in Six real Mirrors (1972-73) or Dali Lifting the Skin of the Mediterranean Sea to Show Gala the Birth of Venus (1977), to name a couple, to paint his last visual poems. Neret, 1997) Dali also had a couple of exhibits in the final stage of his life. Some of these included exhibits in Rome and Venice, nuclear mysticism, in 1951, and at the National Gallery, in Washington, DC, in 1956. Dali continued to work on paintings and books, and continued to travel to promote his latest creations, until the death of his wife G ala in 1982. Parents can also bring their children to browse in the library or bookstore and allow them to browse on their own and select the books which genres are to their preference. These days, just as much as advanced degrees and familiarity with independent schools, independent schools look for experience in the classroom. It used to be 25 years ago that if you went to a wonderful college, you could walk into an independent school and start teaching. That’s not true these days, except perhaps in the suburbs in Connecticut and New Jersey. In New York City independent schools, the position open to people with that background is the assistant teacher in elementary grades. It’s the easiest entry-level position. You need a strong undergraduate degree and some experience working with children. The more academic schools really look for someone who’s had more professional experience and who’s halfway through a master’s or done some student teaching. Even that is more difficult for someone with a B.A. Schools will make an exception for an alumna or alumnus sometimes. Why is prior teaching experience so important? One of the situations that teachers in independent schools may face is a parent asking why a student isn’t getting an â€Å"A.† Kids will complain too if the teacher doesn’t have experience. The schools want to make sure the teacher is prepared to deal with these types of situations. On the other hand, teacher candidates shouldn’t worry about where they got their degrees. Some schools are known for certain programs, and these schools aren’t necessarily top tier or Ivy League. People will sit up and take notice at all kinds of schools around the country. What is your advice for mid-career people looking to transition? For the mid-career person, these schools have an individualized process. The schools may be looking for someone with professional experience. They may be looking for someone who can do something else, such as development. A career changer can find a job in an independent school. We see an increasing number of career changers who are tired of doing what they are doing. Now, we’re more frequently getting candidates who have done some graduate work in the field. We’ve had people do the New York City Teaching Fellows program even if they’re interested in independent schools, so they can get hands-on training. What is your advice for jobseekers? Get experience in some way. If you are a recent grad, do Teach for America or the NYC Teaching Fellows program. If you can put up with being in a difficult school, it can be an eye-opener. People will take you seriously. You can also try to find a position in a boarding school or another part of the country, where it is more difficult to find the ideal teacher. Boarding schools are more open to intern teachers. They give you a lot of mentoring. It’s a wonderful experience. In addition, write a good cover letter and resume. Some of the cover letters and resumes we see are in poor shape these days. People don’t know how to structure a cover letter introducing themselves. People present themselves badly and praise themselves in the letter and overstate their experience. Instead, keep it brief and factual. Can public school teachers transition to private schools? Yes, they can! Certainly there are lower school teachers who’ve been head teachers in public elementary schools. If it’s someone who’s been tied to testing and a Regents curriculum, it’s harder. If you are coming from a public school, become more familiar with independent schools. Sit in classes, and get an idea of what the expectations are and what the classroom dynamic is. What helps teachers  be successful once in schools? A good mentoring program helps people. Some schools have a more formal one, while some are more informal. Have not only a mentor in your own teaching department, but have someone perhaps in a different area who is not tied in with commenting on how you are teaching your subject and can give you feedback on how you are relating to your students. Being a subject matter expert and a good teacher are both important, particularly in the upper school. Again, that’s part of the importance of the style of the person fitting in with the school. Teachers are always nervous about the demo lesson they have to do as candidates. It’s an artificial situation. What the schools are looking at is the style of the teacher, whether the teacher connects with the class. It’s important to engage the students. Are there any particular areas of growth? Independent schools are always evolving and working to stay at the forefront of learning and education. They are constantly reevaluating their curriculum, even the best schools. Many schools offer a global emphasis in many areas in the curriculum and a greater movement towards interdisciplinary work. There is also a move towards a student-centered approach and modern skills and learning methods. Real world experience is also becoming increasingly important, as are skills in technology, design thinking, entrepreneurship and more, so teachers with life experience might find themselves at the top of the resume pile.

Pantsers and Plotters Which Are You (And Why It Matters) Two Types of Writers: Plotters and Pantsers Writing has always been a passion for the UK-based former journalist Amanda Wills, who now works part-time as a police press officer. Plotter or PantserDo you plan your novel to the nth degree before you type a single word, or do you sit at your computer, take a deep breath and fly by the seat of your pants? If the former, you’re a Plotter; if the latter, you’re a Pantser. Plotters plan novels to the nth degree. Pantsers fly by the seat of their pants and just write. We all know there are pros and cons to both. Knowing exactly what’s coming next means that Plotters are less likely to suffer from writer’s block. They also tend to write faster and more efficiently. Pantsers, on the other hand, have the freedom to let their characters take control, which can be both terrifying and exciting at the same time.I should say now that I am your typical Pantser. Don’t get me wrong, I am in awe of writers who spend months plotting scenes on timelines and building detailed biographies for their characters. When I start a book, I know how it begins, and I normally know how it’s going to end. It’s just the bit in the middle that’s, shall we say, fluid. I then spent about a week playing a kind of story jigsaw, rearranging the scenes until Kate’s disappearance became the main plot and the disappearing pets became the sub-plot.This kind of low-tech approach might not be for everyone, but it worked for me. It helped me spot continuity problems and holes in the story. It became blindingly obvious where I needed more action, and where I needed to slow the pace down.And once I had the scenes in the right order it was a pretty straightforward task to reassemble them on my Word document.Flick Henderson and the Deadly Game was released both as a paperback and ebook this past December, nearly three years after I had that first seed of an idea.Do I regret not plotting the book properly in the first place? The Climate Crisis Global warming: an increase in the earth's atmospheric and oceanic temperatures widely predicted to occur due to an increase in the greenhouse effect resulting especially from pollution. Given the definition it may not sound as scary as it actually is. The whole process of global warming is a science in itself. It may also be known as ‘the climate crisis' because scientists believe that the occurrence of such extreme temperatures will bring our earth to turmoil. Almost) President A1 Gore irected an Academy Award winning documentary on the topic called ‘An Inconvenient Truth'. The film went into great detail on evidence that scientist have found about the effects of global warming. Awareness was the meaning behind Gore's movie but the first step to helping ourselves is knowledge. The Sun plays the main part in the process of global warming. It shines its rays down on earth giving us heat and reflecting back up into the atmosphere. Kind of like when you s hine light in a mirror, it reflects back at you.It has been discovered that the Sun's magnetic field has doubled since 1900. This tells us that changes in the Sun have had a hand in the recent general warming of the earth's climate. If the sun's rays come down on earth and are trapped from going back into the atmosphere it causes the temperature to rise and therefore causes numerous issues with the climate and our personal health. Pollution is the main cause of global warming. It is defined as: the release of chemicals and particulates into the atmosphere. Drama Exploration †Response Essay

For the response phase of our drama exploration unit, we used two different explorative strategies in order to investigate our characters and help us to be able to define them better and also to allow us to be able to really become the character instead of imitating what we think the character is like. The two explorative strategies we use were called, â€Å"The Watering Hole† and â€Å"Marking the Moment†. The character that I play the part of is called Reg from the play â€Å"Table Manners† by Alan Ayckbourne. He is a realtor and is married to Sarah; they have two children and have what may be called a turbulent relationship. The Watering Hole The first explorative strategy which we covered was called â€Å"The Watering Hole†. During this exercise we were to think of what our character would be like as an animal. We were then to think of what it would be like as a group of this animal, much like flock of geese or a pride of lions. Once we had done this we had to think of a name for our group of animals. Then we had to act out what this group of our character would do at a watering hole and how they would react to other character/animals. In addition to this we had to think of a sound that our animal would make and emulate it. Finally we had to show also how our character would bathe and wash himself once at the watering hole. I was placed in a group with four other people who also played the character of Reg. First we decided that the creature that Reg could be most closely associated with is a sloth. His general disinterest in others and their business is reflected in this. We also felt that a major aspect of his character was that he becomes very engrossed in seemingly irrelevant things, such as when he ignores tom when he is talking about Annie and focuses upon the stale biscuits. This helps to show also that he is interested in feeding himself and in food in general. The only quality of his which did not match the sloth was his very short attention span. So eventually we decided to have a creature that was very slow and disinterested in other creatures, but still one that took passion in food and small items. For the name of our ‘group’ we decided to call it a mob due to the fact that mobs are very disjointed and disorganised and each person is an individual and yet they are still moving in a group. This is appropriate because Reg is not an organised person and he would not work well as a group as he is more of an independent creature. For the voice of our creature we came to the decision that his ‘voice’ would need to resemble that of his actual voice; droning and extremely boring as every other character finds him, he would drink from the pool while very engrossed in the water and would splash around in it and be very amused by it, showing some of his immature side. When faced with the task of acting out what our character would do if he were to wash himself, we chose to just flop onto the mattress (our watering hole) and splash the water and just lie in it as her is not interested in washing himself but in playing in the watering hole. We decided to have different reactions to each character. Name Of Character How we would act? Why we would act this way? Norman Be very calm, even friendly, offering a place at the watering hole. Reg likes Norman, in opposition of all the others who all hate him with the exception of Annie and I think Reg finds him extremely amusing. Ruth Be quite disinterested but also quite friendly. Disinterested because they are siblings and lived together for most of their life and friendly as they have a common enemy in Sarah. Annie Treat her like a loving child and keep her safe from others. Reg would do this because he thinks of Annie as his sweet younger sister and likes to take care of her. Tom Reg treats Tom like a friend. He thinks that he is suitable for Annie. Sarah Be very hostile. This is because he hates Sarah and there is no actual love between them. They are only together because of their children. Marking the Moment The second explorative strategy which we used in order to explore our characters was marking the moment. ‘Marking the moment’ is when a moment in a scene of particular significance is emphasised in some way, this may be by freezing the scene or by using thoughts spoken out loud. Since ‘Table Manners’ is a naturalistic play these methods cannot be used and other methods have to be used. The moment we chose to mark was the point in the play at which it is just Reg and Tom alone together in the dining room. Tom is talking about how he thinks that Annie wanted him to take her on a weekend holiday with him and Reg is talking about golf and his childhood days at which point Tom realises he has missed out on a weekend of pleasure with Annie. This moment is significant because it clearly shows Toms realisation and ignorance and Reg’s disinterest in others’ matters, giving us a clear insight into both characters. We marked this moment by using Tom’s facial expressions to show what he was thinking during Reg’s ignorant speech about aeroplanes. This helped me to understand Reg much better because it showed me that he is a very shallow person and only cares about a few things in life; food, golf and his own personal satisfaction. In conclusion I think that these strategies helped me to better understand my character due to the fact that it forces you to think about what your character would be like outside of the set lines in the play and he or she would be as an actual person and this develops the way I can fit into the role of the character in order to fulfil the role.
